With reference to legal precedent, the article attempts to clarify the meaning of the Planning (Listed Buildings and Conservation Areas) Act 1990, regarding the extent to which the listing of a particular property covers a building, its associated structures and other articles. The apparent ambiguity in the application of the law to machinery is examined, and the distinction between `fixtures' and `fittings' explored. The powers of local authorities, or the Secretary of State, in considering applications for listed building consent are summarised, with reference to DoE Circular 8/87 and the draft PPG 15, and the criteria affecting these judgements are indicated. There is also a short note on the connection between listing and inheritance tax regulations. Finally, after detailing the circumstances in which a criminal offence is deemed to have been committed, the sanctions which may be imposed are described. |
