Abstract:
Following the decision by Mr Justice Costello in the High Court in Dublin that the Commissioners of Public Works had no statutory power to build the Mullaghmore (Co Clare) interpretative centre, the Oireachtas (Irish Parliament) passed emergency legislation to allow the Office of Public Works to build and maintain buildings, with validation given to previous work carried out by the Commissioners. The lengthy delays in archaeological legislation for such matters as the appointment of a Historic Monuments Council are criticised with regard to the speed at which the State Authorities (Development and Management) Bill was passed in February 1993.
